My car has been stolen but my insurance doesn't pay, why?

Your car has been stolen and as if this were not bad enough, your car insurance will not pay out either. Why can your insurer do this? Does the insurer have the right to do this? This all depends on a number of factors: including your policy conditions and whether you have taken all necessary measures to prevent theft.

Theft is never covered under a third-party insurance: a third-party insurance only covers the damage that has been done to another person. Do you want to be covered for theft? Then choose a limited or full casco insurance. With one of these insurances, you are initially covered for car theft. Please note that even with these insurances certain grounds for exclusion may apply. Did you not lock the car properly? Is your car key not safely stored or have you failed to meet other security requirements of the insurer? In that case, the insurer may not pay out any compensation.

The insurer also does not reimburse any damage if your car is found within 30 days. If your car is recovered and you have met all the conditions, the insurer will compensate the damage caused to your car by the theft.

Check thoroughly what type of insurance you have. In doing so, look carefully at possible grounds for exclusion from your insurance and the applicable policy terms. Always contact your insurer to find out the exact reasons for refusal. If after this you think you are entitled to the benefit of your insurance, you would be wise to seek (legal) advice. Once you have done this and are (almost) certain that you are in your right, you can think about possible next steps. You can then object to your insurer's decision.

Objection against the decision of your insurer must be made in writing. Make sure you collect everything that can serve as evidence. This could be, for example, receipts for purchased security equipment (cameras, steering locks, extra alarms) or a police report. Make sure you dispute any grounds for exclusion cited by your insurer with added evidence. It is best to use a legal expert to draw up the documents so that you can be sure you are complying with all the requirements of the objection procedure.
