Conflict due to dismissal covered by legal expenses insurance?
With a legal expenses insurance you can choose the coverage yourself by selecting modules. In this way you can tailor the insurance to your own wishes. One of the modules is legal assistance 'work'. This module is also called 'income'. With this module you are insured for legal assistance in case of conflicts at work and you receive legal assistance in case of dismissal.
It may happen that you are dismissed. This may be for various reasons: you do not function well enough according to your employer, you have been ill for a long time, or you have been dismissed because of a reorganisation. When this happens, you want to solve it as good as possible. It is not always possible to come to a solution with your employer.
Should you find yourself in any of the above situations, there are a number of things you can do yourself, if possible:
- Talk to your employer to find a solution
- Keep correspondence (e-mails and/or letters) from/with your employer
- Indicate clearly if you do not understand something and ask for additional explanation or clarification
- Get your employer to write down a proposal. Make sure that you do not immediately agree to the proposal and that you are given time to think about it.
Legal expenses insurance for dismissal
With the 'employment' module you are insured for legal assistance in the event of an employment conflict or dismissal. Do you have an employment conflict with your employer? The legal assistance insurance offers help with both mediation and litigation. Try to work it out with your employer. It could be that you are not fired because of a labor conflict but because of one of the following events:
Instant dismissal
Are you dismissed with immediate effect? Then your employer must have a good reason for this, otherwise the dismissal is not legally valid. A valid reason could be, for example, refusal to work or theft. With this type of dismissal, you lose your job immediately and you are not entitled to a benefit. With the help of a legal assistance insurance, it can be determined whether the dismissal is legally valid.
In case of bankruptcy or reorganisation
If the company you work for goes bankrupt or is reorganised, you may lose your job. It may be that you have not been paid for some time, due to financial problems within the company. With a legal assistance insurance you will get help in finding out what you are entitled to in this situation and to whom you should turn in case you need legal assistance.
In case of non-renewal of a temporary contract
With a temporary contract, your employer must abide by the same rules in the case of interim dismissal as with a permanent contract. This means that the contract cannot be terminated earlier if you do not perform well or if there is less work. When assessing whether the dismissal is legally valid, you can appeal to your legal assistance insurance.
Please note: You are not insured if your dismissal took place before your legal assistance insurance was taken out.
Is legal expenses insurance mandatory?
A legal assistance insurance is not obligatory, but proves to be very useful in practice. Do you work abroad? It is possible that insurers only offer coverage in the Netherlands and not throughout Europe for certain disputes. Pay close attention to this.
