What is WIA?
WIA stands for Work and Income according to Labor Capacity Act. This is the law governing incapacity for work. If your employee is incapacitated for work for more than two years, the employer's obligation to continue paying wages ceases. In that case, your employee falls under the WIA. He will then receive WIA benefits from the UWV.
What is WIA insurance?
If your employee ends up in the WIA after two years of continued payment of wages, they will receive a statutory WIA benefit from the UWV. As an employer, you can also take out WIA insurance for your employees. WIA insurance supplements the WIA benefit that your employee receives in the event of long-term incapacity for work. WIA insurance: WGA and IVA
The Work and Income according to Labor Capacity Act consists of two types of benefits: the WGA (Return to Work Scheme for People with Partial Disability) and the IVA (Income Provision for People with Full Disability).
- Return to work for partially disabled persons (WGA)
The employee receives WGA benefits if he has been ill for two years or longer and is between 35% and 80% incapacitated for work. Even if your employee is more than 80% incapacitated for work but has a chance of recovery, he will receive WGA benefits.
- Income provision for persons who are completely unable to work
The employee receives an IVA benefit if he is completely and permanently incapacitated for work. In that case, the employee is unable to work or can only work to a very limited extent, and there is very little chance of recovery. This involves a percentage of more than 80% incapacity for work.
Am I required to take out WIA insurance?
No, as an employer, you are not legally obliged to take out WIA insurance. You can decide for yourself whether or not to offer WIA insurance to your staff. However, a number of collective labor agreements do stipulate that taking out WIA insurance is mandatory. You can offer WIA insurance on a collective basis. Your employees can then decide for themselves whether or not they want to participate in the insurance.
