What is public liability insurance?

Business liability insurance covers damage caused by you, your employees, or hired freelancers to other people or property during the course of your business activities. This includes both property damage and personal injury.

AVB is not required

It is not a legal requirement for companies to have public liability insurance. Companies are free to choose whether to insure themselves against damage they cause to others. However, many clients and industry organizations do require public liability insurance as a condition for working together.

AVB insurance protects your business

Business liability insurance protects you against the costs of damage you cause during your work or on company premises.

Without general liability insurance, you run a significant financial risk as an entrepreneur or self-employed person. This is especially true if personal injury is involved. A single claim for damages can quickly cost thousands or tens of thousands of euros.

In the event of a claim, the insurer may engage a loss adjuster to determine the cause, extent, and liability for the damage, so that the claim can be handled carefully.

Business liability insurance covers damage to:

Persons and their possessions.

An employee's belongings.

Injury or death of an employee.

Persons and property caused by a temporary worker, intern, or volunteer.

Environmental damage that is sudden or incidental.

Consequences for which you are liable for your product.

In most cases, general liability insurance provides coverage in the Netherlands and usually also within Europe and the United Kingdom.

Business liability insurance does not cover damage to:

Yourself, your belongings, or your business.

Damage caused intentionally.

Fines or guarantees.

A product or service that must be re-executed or re-delivered.

Consequences of professional errors. For this, you need professional liability insurance.

The environment, when the damage occurs gradually or takes place at the business location.

Items that you are responsible for, such as a kitchen or bathroom that you need to install.

Objects damaged by motor vehicles.

Always check the insurer's policy conditions to see what exceptions there are.

Not all employees are co-insured by default

With liability insurance (AVB), the company itself is the policyholder and thus insured for damage to persons or property of third parties. In many cases, employees are also co-insured. This means that damage they cause during their work is covered through the AVB.

Not all employees are automatically co-insured. Certain professions, such as doctors or lawyers, often require separate professional liability insurance policies. Therefore, always check the coverage and terms of your AVB to know who is insured and purchase additional insurance if necessary.

Cost of corporate liability insurance

The cost of an AVB is different for every business owner. Are you a marketer and work mostly in the office? Then you will pay less premium than the owner of a small painting company. Your profession and the size of your business affect the cost of your business liability insurance.

Factors of premium level

The following factors determine the amount of your premium:

The number of employees you employ

The industry in which you operate and the profession you practice

Your gross annual salary and annual sales

The chosen insured sum

Any membership in a trade association or umbrella organization

Product liability and general liability insurance

Product liability concerns damage caused by a defective product that you sell. Many entrepreneurs want to know whether product liability is covered by their business liability insurance (AVB). In practice, product liability is often included in AVB insurance, but this is not always the case.

If a product causes damage to another person, this may constitute defective product damage. Whether this damage is compensated under the general liability insurance depends on the policy conditions and the specific circumstances of the damage. It is therefore important to check carefully whether, and in which situations, this cover is included in your business liability insurance, so that you are not faced with any surprises in the event of unexpected damage claims.

Frequently asked questions about liability insurance for businesses

Who is business liability insurance for?

Business liability insurance is for small and large entrepreneurs, sole proprietors and sole proprietors. After all, any business can face liability damages.

What is not insured with business liability insurance?

Business liability insurance does not cover professional liability. You will need to take out professional liability insurance for this.

In addition, items that you have 'under supervision' are not automatically covered by insurance. These are items belonging to someone else that you are working on or that you are temporarily managing, such as a kitchen or bathroom that you are installing. You can often insure these items, usually up to an amount of €5,000. Please contact customer service for more information.

Always check the policy conditions to see if there are more exclusions. This varies by insurer.

Is business liability insurance mandatory?

No, business liability insurance is not mandatory. However, it can be a very useful addition to your business insurance. After all, an accident is in a small corner and it is not nice if you have to pay for the financial consequences of a damage yourself.

Moreover, suppliers or clients increasingly do not want to do business if someone is not insured.

Why should you take out business liability insurance?

Liability insurance is an important type of insurance for your business. While working, you or one of your employees may accidentally cause damage to other people's property or to other people themselves.

When personal injury occurs, the costs can quickly reach tens of thousands of dollars. Business liability insurance provides coverage in many situations and can then be the solution.

What is the difference between business liability insurance (AVB) and professional indemnity insurance (BAV)?

Business liability insurance is often confused with professional liability insurance.Professional liability insurance covers financial losses incurred by your client as a result of a professional error for which you are liable. It is particularly relevant for entrepreneurs who provide advice in their work, such as consultants or engineers.

What is the difference between business and personal liability insurance?

Personal liability insurance covers damage in private situations, while business liability insurance covers damage during work. Business damage claims are therefore not covered by personal insurance.

Can you use private liability insurance for business purposes?

Using private liability insurance for business purposes is not permitted. If you are held liable for damage during work as an entrepreneur, you need business liability insurance that specifically covers commercial risks.

Is business liability insurance tax deductible?

Yes, in many cases, business liability insurance is deductible as a business expense. The premium is considered an operating expense and therefore reduces your profit. Be sure to check with your accountant to see if this applies to your business.

What is supplementary coverage and when should I take out supplementary insurance?

Taking out additional insurance is wise if you work with increased risks or carry out specific business activities that fall outside the standard coverage of your general liability insurance. Therefore, always check the terms and conditions and take out additional insurance where necessary.
