Damage caused by a car wash: Am I covered?
Should you wash your car by hand, or take it to a car wash? Which do you prefer? Because of the convenience and speed with which you can get the job done at a car wash, many people choose the latter option. But is it really a good idea to have your car washed at a car wash?
Risk of damage
Although car wash technology has improved significantly compared to a few years ago, the risk of damage still exists. You wouldn’t be the first person to find a missing side mirror or antenna when driving out of the car wash. However, if you drive your car into the car wash undamaged, you naturally expect it to come out undamaged as well. But what if that’s not the case? Can you hold the car wash liable, or is it covered by your auto insurance?
It's my own fault
To ensure that the car wash process goes quickly and smoothly, follow the instructions provided as you drive into the car wash. If you fail to do so and your car sustains damage in the car wash—or if you are informed in advance that your car is not suitable for the car wash—you are personally liable for the damage. In that case, you’re only covered if you have auto insurance with third-party liability and comprehensive (all-risk) coverage.
Do I use the car wash at my own risk?
Did you follow the staff’s instructions, yet your car still sustained damage when it came out of the car wash? If so, this could lead to quite a bit of debate. The car wash company may point out that using the car wash is at your own risk. But can the car wash company get off so easily? The answer is no. You’ll never see a sign saying “Use at Your Own Risk” at car wash companies affiliated with BOVAG. Car washes affiliated with BOVAG have general terms and conditions that clearly outline the responsibilities of both parties. Unless the customer is at fault for the damage to the car, compensation is provided up to a maximum amount of approximately €4,500.
I have damage... now what?
If you suspect that your car was damaged at the car wash, report it immediately to the car wash operator. It is, of course, important that you provide evidence showing that the damage was actually caused by the car wash. In addition to informing the operator, you should therefore document the damage immediately by taking photos. Also, fill out a damage report form together with the car wash staff and gather witnesses if possible. Finally, legal expense insurance will, of course, help you recover the costs of the damage.
