Do I have an obligation to report after every data breach?

If your organisation is affected by cybercrime, personal data of third parties may end up in the hands of criminals. If this results in a security incident, this is called a data breach. A data leak is considered a breach of the privacy legislation. As a company you are, in most cases, obliged to report this to the Dutch Data Protection Authority and sometimes also to the parties involved whose data has been leaked. When should you report a data breach?

As indicated earlier, you are not obliged to report every data breach to the Authority for the Protection of Personal Data. It depends on the (possible) impact of the data leak. The nature of the leaked personal data plays an important role.

The information that you generally need to report immediately includes

  • Login data, such as user names and passwords;
  • Financial data of the persons concerned;
  • Medical and psychological data;
  • Social data of a personal nature
