What is passenger insurance?

As a supplement to your car insurance you can take out a passenger insurance. There are two different passenger insurances.

Accident insurance

Accidental occupant insurance pays fixed amounts in the event of death or permanent disability of the driver and/or passengers.

The amounts are agreed in advance in the policy and there is no relationship between the amount paid out and the actual damage suffered. Coverage applies when the occupants are in the car, but also, for example, while getting in and out of the car or while making emergency repairs on the road. Material damage is not covered by passenger accident insurance. For this you can take out passenger accident insurance.

Damage insurance for passengers

The passenger indemnity insurance compensates the damage suffered by the driver and passenger(s) in the vehicle concerned.

This damage may include property damage (clothing, luggage, etc.), loss of earnings, household help, transport costs, medical costs, compensation and funeral costs. The maximum insured amount per event for all insured persons together is usually about 1 million euros.

With the passenger indemnity insurance, it does not matter who is at fault for the accident. When one of the passengers suffers a loss due to an accident and this loss cannot be recovered from another insurance company, then the passengers can claim this loss on the passenger indemnity insurance. Especially when the other party cannot be traced, this is desirable.

If the driver is at fault for the accident, the passengers do still have the option of holding the vehicle's third-party insurance liable and recovering any damages from them. If the question of guilt is unclear, this can be a long process. By taking out passenger indemnity insurance, you avoid this process. can help you recover your personal injury from the other party.

Pay the agreed amount once in the event of death and permanent disability (total or partial) pays for all actual material damage and personal injury incurred in the accident, provided that such damage is not compensated for on another insurance policy (in the alternative) and up to a maximum of the sum insured
Sum insured discussed and determined in advance (in case of partial and permanent disablement not the full sum insured but a percentage thereof after examination by the occupational physician and in accordance with the Gliedertaxe) All actual damage (in the alternative) suffered by the occupants up to a maximum of EUR 1 million
Psychological injury is not covered In most cases, compensation/psychic injury is included in the insurance.
Payment is independent of the person(s) who may be held liable for the collision. One can hold the (insurer of the) perpetrator liable and this insurer is not allowed to deduct the OI payment. Actual damages are paid and insurer can recover paid damages from liable party (insurer)
No link between amount paid and actual damage suffered Damages paid are the actual damages suffered and proven


The cover under a passenger indemnity insurance is subsidiary/complementary, i.e. only if damage is not compensated for by another insurance.
