Consumer and living module
One of the modules is legal assistance 'consumer and living'. What exactly is insured with the 'consumer and living' module? With this module, you are insured for legal assistance with the entire family, within the European Union, in a variety of consumer issues, such as purchases (retail or online) and problems with a supplier of energy, telephone or Internet. Has damage been caused to your home (in the Netherlands), or are there disputes concerning your home (such as buying/selling/renting/maintenance/renovation)? These are also insured. As well as disputes with neighbors or family.
Divorce is excluded on most policies because this is a dispute between 2 insureds on the same policy.
Legal aid living
With the legal assistance insurance "consumer and living" you are assured of legal advice in conflicts concerning consumer matters. These conflicts can be related to the purchase of a product, the delivery of a purchased product and when you want to reverse a purchase.

In addition to the aforementioned legal assistance in the consumer category, this module also includes the legal assistance for housing category. This includes conflicts about the sale of your home, conflicts with your contractor and also neighbor disputes.
Please note: You have a waiting period of 3 months after taking out the consumer and housing module. You are not insured for a conflict that arises during the waiting period. For conflicts about things you buy or contracts you enter into after the effective date of your legal assistance insurance with the consumer and living module, you have no waiting period.
Legal expenses insurance covers the costs of smaller disputes and traffic cases, as well as legal and other expert mediation. The other coverages can be taken out separately. Legal expenses insurance is not mandatory, but in practice it proves to be very convenient. For certain disputes, insurers may only offer coverage in the Netherlands and not throughout Europe. Pay close attention to this.
Is rental property covered by legal expenses insurance?
Are you planning to rent out your home? Then it would be wise to check how exactly this relates to your home insurance, such as building insurance, contents insurance, liability insurance and legal assistance insurance. When renting out, it is nice to have legal assistance insurance, because a legal conflict can easily arise. For example, if your tenant does not pay the rent on time or if he damages the property. However, it varies per insurer whether renting out your property is covered under your legal expenses insurance.
What is covered?
It varies by insurer exactly what is covered when renting out your property. In any case, you can claim legal help and advice in disputes with your tenant with a legal expenses insurance. Do take into account the waiting period of a legal expenses insurance. After taking out legal assistance insurance, you will in fact have a waiting period of 3 to 6 months before you can call on it. Also, ongoing conflicts are excluded from coverage. Are you planning to rent out your property in the future? Then take out legal expenses insurance now.
Private legal expenses insurance is for individuals. If you own multiple properties that you all rent out we speak of business rentals and thus you need business legal expenses insurance. Even if you rent out the property as office or practice space, this is often not covered.
What does legal expenses insurance cover in rental disputes?
Both the tenant and landlord of a house have rights and duties. The rent should be paid on time and the house should be well maintained. In the unlikely event that you get into a rental dispute that you cannot resolve with the other party, it is nice if you can get legal help.
Rental property
When you are going to rent out a property, it is wise to draw up a rental contract. You will record the agreements made in it and the lease will be signed by both parties. The lease can also include the recording of the property. Upon termination of the lease, the property must be in the same condition as when the lease was entered into or as stated in the survey. You do not have to repair normal wear and tear. If there is no recording certificate and it is claimed by the landlord that you have made changes to the property then the landlord must prove this. The same applies to any damage to the rental property.
If you had permission from the landlord to make major changes then you do not have to restore them. If there was no permission from the landlord then the property must be returned to the same condition when you give notice of the lease as it was when you entered into the lease. It may also be the case that for changes that constitute an improvement, the landlord does not want you to reverse the change. You can even request compensation for improvements to the property. Discuss this with the landlord. If you cannot come to an agreement with the landlord, you can turn to the legal assistance insurance 'rental property'.
The maximum amount you can spend under your legal expenses insurance can be found in the policy conditions. If you incur more costs than the amount you are insured for, those costs are for your own account.
