  • Do not move injured people. Call 112 for ambulance or police. (If slight damage to the vehicle, this is not necessary in the Netherlands)
  • Immediately fill in the claim form together with the persons involved. Do not leave the scene of the accident without leaving any information. This is a criminal offence!
  • Take the vehicles to a safe place, if possible. If the road is not blocked, it is better to leave the vehicles.
  • Do you want to move the car? Make sure you take as many good pictures as possible of the situation and damage.
  • Use the warning triangle to warn other road users.
  • Are there any witnesses? Write down their details.

What should you do if you have a car accident abroad? You will have to deal with the laws and traffic regulations of that country. This can mean that a claim for damages must be submitted in a different way than in the Netherlands. Perhaps the other party is liable for the collision under Dutch law, but not under foreign rules of priority. In addition, the way the claim is handled may also differ from country to country.

In the event of an accident, liability must normally first be proven. However, the law states that a driver of a motor vehicle is always liable, unless he can prove force majeure. When the driver of a car, motorbike or moped hits a pedestrian or cyclist, you are liable.
