I am married or in a registered partnership

Dissolving your marriage or partnership can only be done through the court. For this you need a lawyer. In fact, a petition for divorce can only be filed with the court by a lawyer. Before a petition is filed, it is important that you make agreements about matters such as the pension, the house, the division of property, the division of any business and (child) support. These agreements are made by the lawyer in a so-called divorce covenant recorded.

Do you and your partner have minor children? Then you are required to draw up a parenting plan. This contains the agreements regarding the care of the children, how you communicate with each other and child support. Once agreement has been reached and the covenant and any parenting plan have been signed, the lawyer can handle the divorce in writing. In that case, therefore, you do not have to go to court.

I live together and have a cohabitation contract

Unlike a marriage or registered partnership, in this case you do not have to go to court to get a divorce. If you bought a house together, you do have to go to the notary to dissolve the cohabitation contract. The cohabitation contract contains agreements about the division of property when you separate.

If you have bought a house together, you should make proper arrangements for its division. It is advisable to record these agreements in a covenant. For this you can be assisted by a lawyer. In addition, if the house is sold or transferred to one of you, a notary will also be required.

Are there minor children involved?

Even if you are not married, a parenting plan must be drawn up when you separate. In this parenting plan agreements are recorded that have to do with the upbringing and care of the children. For example: visitation arrangements, maintenance agreements and the exchange of information about the children. You can try to make arrangements together about the visitation rights.

Can't come to an immediate agreement with your partner? Then we can involve a joint lawyer or mediator. They are independent and mediate during your conversation with your partner. This way you come to agreements that satisfy both of you. It is wise to submit the final parenting plan to the court so that the agreements about maintenance in particular are well established. This is also a task of the joint lawyer.

Mediation yes or no?

Are you on speaking terms with your partner and want everything settled properly? Then you can choose between a joint lawyer or a mediator. They guide the conversation between you and your partner and put the agreements you make on paper. A mediator and a joint lawyer are always independent because they represent the interests of both of you. There is a difference between a joint lawyer and a mediator.

In mediation, there are more opportunities to discuss the reason for divorce and the emotions involved. A lawyer takes care of the business part, such as handling the divorce with the court. The mediators we work with are also lawyers or, in turn, work closely with a trusted lawyer from their network. In this way extra costs can be saved and everything remains in one hand.
