What does family law entail with legal expenses insurance?

Do you have a particular dispute within your family or household? Then you may need legal assistance. Also called legal aid. This legal assistance can cost a lot of money. A legal assistance insurance ensures that these costs are covered.

But what exactly is covered? Are there differences? And which coverage is best for you? Alpina explains it for you.

Legal expenses insurance coverage

In the first instance the family law legal expenses insurance covers all legal costs that are incurred in the family sphere. Think for example of a disagreement with an inheritance or a divorce (in case of matrimonial disputes often with an additional module). If you cannot resolve the situation with your family, legal aid is often called in. Have you taken out legal assistance insurance for family law? Then these costs will be covered by your insurer.

However, you must have taken out the insurance before you need the legal assistance. Is this not the case? Then the legal aid will not be reimbursed either.

What do you need to look out for?

When taking out legal expenses insurance for family law, there are a number of things you should pay attention to.

What are you insured for?

Many insurances have 'family law' and 'inheritance law' as a cover. However, this does not mean that you are insured for all matters relating to these. It may be that certain insurance policies offer different modules. These modules offer different types of coverage. Mediation between parties, for example, can be an additional module.

Are you insured abroad?

In the first instance, you are only insured within the Netherlands for family and inheritance disputes. But what if you have a dispute with relatives abroad? Then you will have to take out an additional module. With this module you can get legal assistance abroad reimbursed. It is not so much about what the problem is, but where.

Up to what amount are you insured?

Most insurance policies provide cover up to a certain amount. This amount can vary from €25,000 to an amount chosen by you. Some insurers will offer higher coverage than others. It is therefore wise to consider which insurer offers the highest cover for the best price.

Which lawyers do you work with?

It may be the case that you are assigned a lawyer or a solicitor by your insurer. Often, your insurer has a contract with certain lawyers and law firms. Perhaps you can find out in advance where your insurer has contracts with. That way, you can check out reviews and ratings of the lawyers and law firms in question. Then you can be sure that you will get the best help if ever needed.

What is not insured in any case?

In any case, some things will never be reimbursed by your insurer.

Structure

Did you deliberately do something for which you need legal assistance? Then you are never insured for this and you have to pay the legal aid yourself.

Cohabitation

Legal aid with regard to your marriage, cohabitation contract, registered partnership and alimony is not covered in most cases. This is because these cases are very common, which makes the risk for the insurer very high. However, your insurer may offer an additional module for this.

Conflicts and fraud

Conflicts caused by organised violence are not covered. Think of civil wars or uprisings against the government.

Fraud is also never reimbursed by your insurer.
