Does a mobility scooter have an insurance obligation?

A mobility scooter is a motor vehicle. Insurance of this motor vehicle is compulsory, but how do you arrange insurance for a mobility scooter?

A mobility scooter can only reach a low speed, but that does not mean that these motor vehicles cannot cause damage. Damages caused by motor vehicles cannot be claimed on the liability insurance for private individuals. To protect injured parties financially, third-party insurance for the mobility scooteris compulsory. The abbreviation WA stands for third-party liability.

Who is obliged to insure the mobility scooter?

The insurance obligation rests with the person in whose name the mobility scooter is registered. At the moment that the vehicle enters the public road, the mobility scooter has to be insured. But the obligation is broader. Also when using the vehicle outside of the public road, the insurance obligation exists. If you do not insure the mobility scooter, you run the risk of a fine for driving around uninsured. In a collision with an uninsured mobility scooter, there is a bigger problem. The damage caused is namely not recoverable from an insurance company.

Which cover do you choose?

You have a choice between three forms of insurance, namely the third-party, and the all-risk (WA casco). TPL is the cheapest, but also offers only limited coverage. The insurer only pays out for damage to others. The damage to your scooter is therefore your own responsibility. With the all-risk insurance, you also get paid for your own damage in the event of an accident. Depending on the value of the mobility scooter, you choose the most appropriate insurance. The premium should be proportional to the value of the mobility scooter. You are not going to pay hundreds of euros in premium for a mobility scooter with only a limited value.

What does the third-party insurance cover offer?

In the event of a collision, you will be paid for the damage to your own vehicle, but the cover is broader than that. The vehicle is also insured against theft, vandalism, joyriding and damage. In contrast to car insurance, for example, there are no claim-free years. A claim on the insurance therefore does not result in the premium for the insurance increasing in the next insurance year.

Is a mobility scooter a motor vehicle?

In terms of road safety, a mobility scooter cannot be compared to, for example, a car. Nevertheless, the risk of driving a mobility scooter should not be underestimated. After all, it is a mechanically propelled vehicle that can cause serious material damage and injury.

As the owner of a motor vehicle, you bear a strict liability. In the event of an accident with a vulnerable road user, the owner of the motor vehicle is normally liable. It makes no difference whether it is a truck or a mobility scooter.

Does a mobility scooter have an insurance obligation?

Just like a forklift truck, a tractor and a sweeper, the mobility scooter falls under the heading of unregistered vehicle. Vehicles that meet the description of a motor vehicle must be compulsorily insured. The fact that there is no registration number on the vehicle does not mean that there is no obligation to take out insurance. You should at least take out WA (third-party liability) insurance. This insurance covers the damage caused by your mobility scooter. Because of the strict liability, you are legally liable for damage to others. This is different when the other party is also a motor vehicle. In that case, the strict liability rests on both parties.

I do not use the mobility scooter on public roads

Even in that case, the obligation to insure remains. You can still cause damage to others. Third-party insurance is a relatively cheap insurance. The insurance often costs you only a few tenners a year.

Does the private liability insurance provide cover?

A small mistake can cause damage of thousands or even hundreds of thousands of euros. Most people are insured for this kind of damage via the liability insurance for private individuals (AVP). But for the mobility scooter, this is not the solution. Damages caused by motor vehicles are excluded. Even if there is no obligation to insure, insuring the mobility scooter is recommended.

How should I insure my mobility scooter?

Civil liability insurance is compulsory. Depending on the value of the mobility scooter, you can choose to insure the vehicle more extensively. You have a choice between the WA coverage and the all-risk (WA casco). For a new or fairly young mobility scooter, you choose the all-risk mobility scooter insurance. Also for an older mobility scooter it can still be beneficial if the vehicle still has a high value.
